These are the terms and conditions you must agree to prior to using our services.
This Terms of Use (“Terms of Use”) is a contract between you and My Sharp Pen (owners of My Sharp Pen Editing Services) that applies to your use of the services of www.mysharppenediting.com (“website”, “service”) and any related services at our offices. “You” refers to anyone who uses our services on this website or any of our offices. Unless stated otherwise, “My Sharp Pen”, “we”, “us”, “our” will refer collectively to My Sharp Pen, its officers, directors, agents, subsidiaries, joint ventures, employees and suppliers.

 

1.0 Conditions of Use

By using this website or any of our services offline, you certify that you have read and reviewed this Terms of Use and that you agree to comply with its terms. If you do not want to be bound by the terms of this Terms of Use, you are advised to leave the website accordingly. My Sharp Pen only grants use and access of this website, its products, and its services to those who have accepted its terms.

1.1  Age Restriction

You must be at least 18 (eighteen) years of age before you can use this website. By using this website, you warrant that you are at least 18 years of age and you may legally adhere to this Terms of Use. My Sharp Pen assumes no responsibility for liabilities related to age misrepresentation.

1.2 User Accounts

In order to access our services, you would be asked to create a user profile on our website and provide private information. You are responsible for ensuring the accuracy of this information, and you are responsible for maintaining the safety and security of your identifying information. You are also responsible for all activities that occur under your account or password.

If you think there are any possible issues regarding the security of your account on the website, inform us immediately so we may address them accordingly.

We reserve all rights to terminate accounts, edit or remove content and cancel orders at our sole discretion.

You agree that your personal and contact information provided on this website are to be used to facilitate communication between us and you, in order for you to use our services on this website, any of our offices or authorized locations, as well as receive promotional content from us.

1.3 Applicable Law

By visiting this website or any of our offices, you agree that the laws of the Federal Republic of Nigeria, without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort that might come between us and you.

1.4 Permission to Use Material

You hereby give us permission to edit, develop, compress, format and make changes to the documents and other data and materials provided by you on this website or to any authorized agent of My Sharp Pen at any of our offices or authorized locations.

1.5 Copyright

By uploading any document, information, picture or any other material to this website and/or providing any document, information, picture or any other material to any authorized agent of My Sharp Pen in person at any of our offices or anywhere else, you warrant that you have the copyright of such material.

For citations, excerpts or any other form of reproduction of copyrighted material that does not belong to you, you take full responsibility for getting copyright permissions to reproduce parts or whole of any textual, visual, audio or any kind of copyrighted material on any part or whole of your document, video and/or audio file or any other kind of file which you upload on this website or submit through whatever medium in person and/or through your agent to My Sharp Pen.

You agree that My Sharp Pen is not liable and should not be held to any lawsuit or legal action that may result from our using such copyrighted material as uploaded or sent by you to us for the purposes of editing, proofreading, writing, developmental editing, jingle production or any of our services.

You also hereby hold My Sharp Pen harmless against all claims of plagiarism, copyright infringement and other legal claims that may arise from the use and/or misuse of the information, document, picture or any other material provided by you to us.

2.0 Payment

You agree to pay in full for any service you request for, before we commence work on your material.

2.1 Payment Verification

When you upload a document, audio, audio-visual or any other material to our website and/or make a payment on our website or any of our offices after 5pm WAT on a work day (Monday to Friday) or any time during the weekend, we would verify payment and send feedback to you within the next 3 work days.

2.2 Taking Credit

You give us the permission to take credit for editing, proofreading or carrying out any of our services on any of your documents, audio, audio-visual or other material which we proofread, edited, developmentally edited, wrote or carried out any of our services on, and to append our name, website URL and contact information on the front matter or front page or any other part of your book, article, text or any other kind of material in question. This, however, does not give My Sharp Pen copyright over your intellectual property.

2.3 Indemnification

You agree to indemnify My Sharp Pen and hold us blameless against legal claims and demands that may arise from your use or misuse of our services.

2.4 Intellectual Property

You agree that the intellectual property you provide to us on this website and/or any of our offices or authorized locations would be used only for the service requested and paid for by you. The features of each of our services are listed on our website. We advise that you read details of each service carefully before placing an order. My Sharp Pen will not be held liable if you choose a service wrongly. What you choose and pay for is what we would render to you.

2.5 Review

Towards our completion of each service (except CV writing and Cover Letter writing), we would invite you to review your edited, proofread, developmentally edited or written work via the email provided by you when you sign up for our services and you are to review the documents and write out areas that need correction or approve the work done by us on your document. We agree to execute the corrections made by you, only if they are obvious spelling/grammatical errors, in line with the service you paid for and conform to our in-house style.

From the second we send you an invitation asking you to review your document, the review period starts to count. It elapses exactly 48 hours after we send you an invitation. If you fail to make any written comment or observation on the edited, proofread, developmentally edited and/or written document when invited for review, it means that you approve of the work we have done and you approve our sending you the finished copy.

If you fail to review your document within the review period, you forfeit the right to ask for a review or to review the document in question. In addition, not replying to our invitation to review your document and not reviewing the document in question within 48 hours of our sending you an invitation to review your document means that you are satisfied with the work done by us and the document will be sent to you after the 48 hours review period elapses.

Whether you review the document or not, access to the document on our platform will be revoked when the review period elapses.

This term (2.5 Review) does not apply to clients who order CV writing and/or Cover Letter writing. We would not invite clients to review their curricula vitae or cover letters written by us.

3.0 End of Transaction

A transaction is considered completed when we send you the finished copy of your document or other material sent in for our services, via your registered email.

3.1 Number of Words

You hereby agree that we are not bound to send back the edited, proofread, developmentally edited, written and/or any other version of your document in exactly the same number of words that you had initially sent in for any of our services and paid for. We might revise clumsy sentences and make them short, concise and more straight to the point, in order to ensure clarity. The number of words in the version of your document that we send to you may or may not be less, more or the same as the number of words in the document you sent to us.

3.2 Modification

We reserve the right to edit, modify, and change this Terms of Use at any time. We advise that you check this page often to stay updated on any changes made to this Terms of Use.

3.3 Post-submission Changes

My Sharp Pen is not liable if corrections or changes made by us on hard or soft copy documents that you provide are not replicated by you or any of your agents to reflect the exact corrections or changes made by us, and as a result, you and/or your agents make errors on the document or a replica of the document which we sent to you, after it has been edited, proofread, developmentally edited, written or worked on in any form by us.

3.4 Post-submission Error

We are not liable for any error that you or your agents make on soft or hard copy documents already edited, proofread, developmentally edited, written or worked on in any form by us and sent to you before such errors were made.

3.5 Refund

There would be no refunds after payments have been made for any service.

4.0 Overlooked Errors

If for any proven reason, we overlooked errors in any of your documents already worked on and sent back to you by us, we hereby agree to carry out an investigation into the matter and if the claims are found to be true, give a thorough correction of the specified section or sections of the document in question, provided that the content of the document you send us for correction is exactly the same as what we had sent to you after the initially completed work, and no word, punctuation, image or any new content whatsoever has been added to the document. Any addition whatsoever to the document in question, after we have sent it to you, makes your claim for correction null and void.

You must, however, send a detailed explanation via email, stating what errors were overlooked (chapters, pages, paragraphs and sentences should be clearly stated), why the errors should be fixed and the date and time when you received the document after the initially completed work. However, such claims would not be attended to if you make them 10 days or more after we sent the edited, proofread, developmentally edited, written or otherwise worked-on document to you, and/or if you did not review your document when we invited you for a review.

4.1 Harmless Material

You agree not to send, upload or provide any malicious, spammy or harmful material to this website or any of our offices. If we find any of your uploaded or sent materials harmful to our website or any of our systems, we reserve the right to delete it from our website or system. Until you provide us with a harmless copy of your document or other material, we would not be able to carry out the service you order for, even if it is paid for.

4.2 Adherence to Schedule

You agree to adhere to the schedule we would make and inform you of, for each of your uploaded works. If you request for a timeline that is shorter than we have already scheduled for your work, you will be charged an extra 10% of your total fee for that work.

4.3 Our Copyright

Contents of this website are the exclusive copyright of My Sharp Pen. You, however, have the copyright to materials you upload to this website.
